Privacy & Refund Policy

Your privacy is important to us. It is our policy to respect your privacy regarding any information we may collect from you across our website, viralvant.com, and other sites we own and operate, as well as through our SaaS application (collectively, the "Service"). This policy also outlines our refund and dispute resolution procedures.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from the Service or use our application.

Scope of this Policy: This policy applies to information collected by Viralvant through our Service. It does not apply to information collected by third-party scripts, tracking codes (like Google Analytics), or other technologies that you, our client, may choose to embed or implement on the landing pages you create and host using our Service. You are responsible for the privacy practices related to data collected on your landing pages via such third-party tools, including providing necessary notices and obtaining consents from your visitors as required by applicable law. Please refer to our Terms and Conditions for more details on your responsibilities.

1. Information We Collect

We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. We also let you know why we’re collecting it and how it will be used.

Information you provide directly or via third-party authentication:

  • Account Information: When you register for an account directly, we collect information such as your name, email address, company name (optional), and password.
  • Google Authentication: If you choose to register or log in using Google Authentication, we receive certain profile information from your Google account. The specific information depends on the permissions granted during the authentication process but typically includes your name, email address, and profile picture. We use this information solely for authentication and account setup purposes. We do not receive your Google account password.
  • Payment Information: When you subscribe to a paid plan, we collect payment information through our third-party payment processor (e.g., Stripe). We do not store your full credit card details ourselves.
  • Communications: If you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide.

Information we collect automatically:

  • Log Data: When you use our Service, our servers automatically record information ("Log Data"), including information that your browser sends whenever you visit our website or your mobile app sends when you use it. This Log Data may include your IP address, browser type and settings, the date and time of your request, how you used the Service, and cookie data.
  • Usage Data: We may collect information about how you use our Service, such as the features you use, the content you create or interact with, and the frequency and duration of your activities.
  • Device Information: We may collect information about the device you are using to access the Service, including hardware model, operating system, unique device identifiers, and mobile network information.
  • Cookies and Similar Technologies: We use cookies and similar tracking technologies to track the activity on our Service and hold certain information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.

3. How We Share Your Information

We do not share your personally identifying information publicly or with third-parties, except when required to by law, or under the following circumstances:

  • Service Providers: We may share your information with third-party vendors and service providers that perform services on our behalf, such as payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance. These third parties only have access to your information to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
  • Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.
  • Legal Requirements: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, prevent or investigate possible wrongdoing in connection with the Service, protect the personal safety of users of the Service or the public, or protect against legal liability.
  • With Your Consent: We may share your information with third parties when we have your explicit consent to do so.

4. Refund Policy & Right of Withdrawal (EU)

EU Consumer Right of Withdrawal: If you are a consumer based in the European Union, you have a statutory right to withdraw from your initial subscription purchase within 14 days from the date of purchase without giving any reason.

To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement (e.g., an email to support@viralvant.com). You may use the model withdrawal form provided by EU law, but it is not obligatory. The withdrawal period will expire after 14 days from the day of the conclusion of the contract (i.e., your initial subscription purchase).

Effects of Withdrawal: If you withdraw from the contract within the 14-day period, we will reimburse to you all payments received from you for that initial subscription period without undue delay, and not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Exception to Withdrawal Right / Use of Service: Please note that if you begin to use the Service (e.g., by consuming credits provided by your subscription) before the 14-day withdrawal period expires, you expressly request and consent to the immediate performance of the contract. By doing so, you acknowledge that you lose your right of withdrawal once the service has been fully performed or significantly utilized (e.g., a substantial portion of credits used). If the service has been partially performed at your request before withdrawal, you may be required to pay a proportional amount for the service provided up until the point of withdrawal.

General Refund Policy (Outside EU Withdrawal / After 14 Days): Outside the EU statutory 14-day withdrawal period, or for renewals, refunds are generally not provided. Our subscriptions grant access to the Service and provide a specific number of credits for use within the billing period. As these credits are made available immediately upon subscription or renewal, we typically do not offer refunds for partial subscription periods or unused credits.

However, we may consider refund requests outside the standard policy on a case-by-case basis under exceptional circumstances, evaluated at our sole discretion.

Refunds, when approved (either via withdrawal or exception), are typically processed within 5-10 business days to the original payment method. Transaction processing fees may not be refundable.

5. Dispute Resolution

We aim to resolve any disagreements or disputes amicably and efficiently. If you have an issue with our service or billing, please contact our support team first at support@viralvant.com to allow us the opportunity to address your concerns.

If a resolution cannot be reached through direct communication, disputes may be escalated according to the procedures outlined in our Terms and Conditions, which may include mediation or arbitration.

Initiating a chargeback with your payment provider without first attempting to resolve the issue with us may result in the suspension or termination of your account.

6. Data Retention

We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification. You can request deletion of your account and associated data by contacting us.

7. Security

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

8. Your Data Protection Rights

Depending on your location, you may have the following rights regarding your personal data:

  • The right to access – You have the right to request copies of your personal data.
  • The right to rectification – You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.
  • The right to erasure – You have the right to request that we erase your personal data, under certain conditions.
  • The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.
  • The right to object to processing – You have the right to object to our processing of your personal data, under certain conditions.
  • The right to data portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

9. Children's Privacy

Our Service does not address anyone under the age of 13 ("Children"). We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from a child under age 13 without verification of parental consent, we take steps to remove that information from our servers.

10. Links To Other Sites

Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

11. Changes to This Policy

We may update our Privacy & Refund Policy from time to time. We will notify you of any changes by posting the new Policy on this page. We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the "Last updated" date at the bottom of this Policy.

You are advised to review this Policy periodically for any changes. Changes to this Policy are effective when they are posted on this page.
